Can I file from abroad?

No. The application is filed electronically in MOS, but at the moment of filing you must be in Poland and staying here legally: on a visa, visa-free or on a valid card. It is signed with a profil zaufany or a qualified e-signature, and a profil zaufany requires a PESEL, which non-EU citizens can only get in person. So a newcomer starts with meldunek and PESEL. We can prepare the document pack remotely before you arrive.

What replaced the passport stamp?

The filing stamp is no longer issued. After filing through MOS you receive a UPO (Urzędowe Poświadczenie Odbioru) and can download the zaświadczenie o złożeniu wniosku. If you filed while your stay was still legal, these documents confirm your right to remain in Poland for the whole procedure, even after your visa expires. They do not replace a visa for travel abroad.

Can I work while waiting?

Yes, if the basis is employment and you already held a zezwolenie (work permit) at filing. Otherwise - under the rules of your previous stay permit.

What changes in 2026?

All filings only via MOS v2.0 (new online application system), correspondence via eDoręczenia (e-delivery) - ePUAP (e-government portal) or qualified signature needed. Wojewoda (regional governor) offices no longer accept paper filings.

You can appeal (odwołanie) to the Head of the Office for Foreigners within 14 days of receiving the voivode's decision. The appeal goes through the voivode who issued the decision: one sent straight to UdSC is returned to the voivodeship office and the case slows down. We draft the appeal, you sign and file it. Against the Head of UdSC's decision you can bring a complaint to the WSA within 30 days; in court you are represented by an adwokat or radca prawny, we do not appear in court.

Do I need to take a Polish exam?

For TRC - no. A B1 certificate is needed for EU long-term resident status and for citizenship. Permanent residence has no language requirement on any ground.

How long does a residence card really take in Warsaw in 2026?

At the Mazowiecki Urząd Wojewódzki a decision usually comes 6-14 months after filing, and the statutory deadline is not met in practice. Renewals tend to move faster than first cards. If the deadline is long past and your MOS status won't change, check eDoręczenia first: the office may be waiting for documents from you. If not, you can file a ponaglenie and, after that, a complaint about inaction to the WSA.

Can I change employers while my case is pending?

Yes, but the employment ground is tied to a specific employer, position and salary. If you move to another company mid-procedure, tell the urząd and submit the new employer's documents: the contract and their Załącznik nr 1. If you stay silent, the voivode will assess a job that no longer exists and refuse. Ideally switch from one day to the next, with no off-the-books weeks between contracts.

Can I leave Poland while the case is pending?

The UPO and the zaświadczenie o złożeniu wniosku confirm legal stay in Poland only, and they are not travel documents. You can leave, but you will need a valid visa or visa-free entry to come back. Without one, serious trips are best postponed until you have the card. Załącznik nr 1 holds up more filings than your own documents

You cannot fill in the employer's annex in MOS on their behalf. The system emails them a link, and they have to sign it with their own profil zaufany. The link lasts 30 days. Most delays come from a small-company director who has never set up a profil zaufany, an email that landed in spam, or the wrong address. The other trap is a PKD code that doesn't match CEIDG or KRS: the voivode spots it and sends a wezwanie. So we contact HR before the application even starts.

Why Mazowieckie refuses

Income comes first. The salary on the contract is below the minimum wage (4,806 PLN gross in 2026) because an old contract was never updated with an aneks. Next come employer-side problems: an unsigned Załącznik, an outdated PKD code. Then gaps in employment, mismatched addresses and meldunek, earlier refusals or returned applications. The hardest cases are those where the voivode suspects a sham contract or a marriage of convenience (obejście prawa). Most of this is visible before filing if you read the file the way an inspector will.

What the urząd asks for

A wezwanie do uzupełnienia braków now arrives only through eDoręczenia, never on paper. You usually get 7 days to answer, and if you miss the deadline the application is left unexamined. Typical requests: a current contract or aneks, a fresh ZUS certificate or RCA reports, PIT-11, a corrected Załącznik nr 1, an apostille on a child's birth certificate. An unopened message still counts as delivered after 14 days, so we check the case correspondence every week instead of waiting for notifications.

How long it really takes

The statutory deadline hasn't been met in Mazowieckie for years. In 2026 a decision takes 6-14 months on average: first cards sit near the top of that range, renewals nearer the bottom. The fingerprint appointment comes through eDoręczenia. In the cases we run, the whole path from gathering documents to holding the card averages 6-8 months, because the file goes in complete and no wezwanie sits unanswered. When the deadline is long gone and the status won't move, we first check for a pending wezwanie, then file a ponaglenie.

Mistakes we see most often

Filing on an old contract that pays less than the new minimum wage. Leaving a renewal to the last week, when the application has to go in while your stay is still legal. Believing the application was filed when it is stuck in "robocza" status because the signature failed and no UPO ever came. Changing jobs mid-procedure without telling the urząd. Leaving Poland without a visa to come back on. And forgetting to collect the finished card: you have 60 days after the notice, then the permit is lost.

What MOS 2.0 changed

Since 27 April 2026 paper is refused, only MOS filings count. You log in through login.gov.pl, and a profil zaufany requires a PESEL, so a newcomer first needs meldunek and PESEL, which non-EU citizens can only get in person. Each adult in the family creates their own account. The portal takes no payments: the stamp duty (440 PLN for work and Blue Card, 340 PLN for other grounds) and the 100 PLN card fee go by bank transfer with the applicant's name in the reference, and the receipts are attached. The passport stamp is gone, replaced by the UPO and the zaświadczenie o złożeniu wniosku.
