Two documents get requested in Poland more often than anything except a company register extract: the ZUS certificate of no arrears in social security contributions and the tax office certificate of no tax arrears. The first is free; the second costs PLN 21. Both take a day or two, provided there are no arrears.
The difficulty is rarely in obtaining them. It is in the timing: someone asks for them at short notice, and the system surfaces a twelve-zloty underpayment from three years ago.

For a foreign entrepreneur the first two rows matter most. In a business-based residence case the wojewoda examines not only income but payment discipline: arrears at ZUS read as instability in the business. We covered the income thresholds in the business grounds article.
How to obtain them
ZUS. Through the PUE ZUS portal - the application is filed online and the certificate usually arrives electronically within a day, sometimes immediately. Paper versions come from a branch. Cost: PLN 0.
Tax office. Through the e-tax office or on paper, using form ZAS-W. Stamp duty: PLN 21. One day to a week, depending on the office.
Through a representative. Both are obtainable under a power of attorney - ZUS-PEL for social security, PPS-1 or PPO-1 for tax. That is how we work: no logins, no queues.
One point to note: electronic certificates work inside Poland, but an apostille needs a paper original. If the document is going abroad, order paper from the start. Why that is.
How fresh they must be
There is no statutory expiry; the certificate reflects the position on the day of issue. In practice:
- the wojewoda - usually accepts one no older than one to three months;
- tenders - typically three months, sometimes six;
- banks - most often 30 days;
- leasing and factoring - 30 to 90 days.
Ordering in advance is pointless: the position can change in a week and a fresh certificate costs 21 zloty.
When arrears do exist
The familiar scenario: the certificate is needed tomorrow and the system shows a debt. Options, fastest first:
1. Pay and wait for posting. Payments post at ZUS in one to three working days and at the tax office in one to five. The quickest route for small amounts.
2. Check whether the debt is real. Half the "arrears" we see are posting errors: a payment sent to the wrong contribution account, a return filed with a typo in the tax ID, or a contribution allocated to the wrong period. The review takes a day and costs nothing to fix.
3. An instalment arrangement or deferral. For larger sums both ZUS and the tax office allow instalments. Once agreed, a certificate of no arrears taking the instalment arrangement into account is issued, and many procedures accept it on a par with a clean certificate. Not all of them, so confirm the requirement first.
4. Check limitation periods. Some older liabilities may be time-barred; that is assessed case by case.
A detail about limited companies
A company needs certificates for the entity itself. In tenders and for some licences, documents concerning board members are added - and those cover their personal liabilities, not the company's.
Tenders also call for the collective entity criminal record certificate - a separate document frequently confused with clearance certificates.

Frequently asked questions
Is the ZUS certificate chargeable? No. Only the tax certificate carries a fee, of PLN 21.
My company was registered last month. Will they issue one? Yes; the system will show no arrears. The company must be registered and hold a tax ID.
Are the certificates needed if my sole trader business is suspended? Yes. Suspension does not cancel liabilities from earlier periods.
Will the wojewoda accept an electronic certificate? Yes - a file or scan is attached when filing through MOS v2.0. Paper is only needed for an apostille.
The arrears are five zloty. Does that really block the certificate? Formally, yes - any arrears prevent a clean certificate. Which is why checking the balance comes first.
Can I get a certificate for a past period? The certificate reflects the position on the day of issue. History is proven with other documents, such as ZUS insurance period certificates.
Both certificates are a one-day formality while the balance is clean. When it is not, the formality becomes a week of clarifications - exactly when the document is urgent. Check the balance early, not the day before filing.
